What type of damages are available in a personal injury case?

The law in Louisiana specifies two types of damages you can seek in a personal injury case: general damages and special damages.

General damages

These are injuries and/or damages for which exact dollar amounts cannot be calculated:

  • Disability
  • Loss of enjoyment in life
  • Loss of consortium, or the relationships you had with loved ones
  • Mental anguish
  • Pain and suffering, in the past, present, and future

Special damages

For specific losses and costs incurred by your injury, you can be awarded compensation on the following:

  • Accident-related medical expenses, both past and future
  • Lost wages, both past and future
  • Funeral or burial expenses (for a wrongful death claim)
  • Vehicle or property damage

It is possible that the party that is at-fault is so negligent that the victim(s) can be awarded punitive damages, which are damages beyond the above described. However, these types of damages are very difficult to prove, and they aren’t often rewarded.
